scope of application

  1. Die DCEM - Die CE-Mentoren Dr. Ostermann & Partner Ingenieure,
    Auf dem Senkel 40,
    53859 Niederkassel,
    Internet: www.cementor.de,
    hereinafter referred to as "engineers",
    write expert reports, comments, specialist publications, develop tools, give lectures and create concepts for events.
    The engineers also operate the websites cementor.de, ce-mentor.de, ce-mentor.com (hereinafter referred to as "website"), on which the engineers are represented. 
  2. The subject matter of these general terms and conditions (hereinafter referred to as "GTC") are, on the one hand, the relationships between engineers and customers (hereinafter referred to as "customer") within the scope of their activities.  
  3. By commissioning the engineers, the customer accepts these GTC. These GTC are part of every contract for the use of the services offered in "scope of application" 1, 2 and 4.
  4. All assignments for
    - Expert evidence
    - Commentaries
    - Publications
    - Development of Tools
    - Presentations
    - Concepts 
    and 
    - Visits to the websites
    are covered by these GTC.
  5. Conditions of the customer that deviate from these GTC do not apply, even if the engineers do not expressly contradict them. Changes and additions to these terms and conditions require the express written consent of the engineers. Oral promises and side agreements require written confirmation by the engineers to be effective. 

Booking

Our events must be booked in writing by post, email or fax. A contract for the engineers' event is only concluded after the engineers have confirmed the booking to the customer in writing. Since the dates for our seminars are usually limited, we consider bookings in the order in which they are received. Bookings are made within the engineers' systems using electronic data processing.

Payments

The invoice amount must be transferred to the account given with the invoice within 14 days of the invoice being issued. 

Services provided by the organizer

  1. Participant participation in the events as agreed.
  2. Detailed training materials on the website www.maschinenrichtlinie.de. Access to the website must be booked separately by the customer.
  3. We would like to point out that room bookings at the event location are the sole responsibility of the participant. The engineers have no obligation to provide overnight accommodation for the participants.
  4. Other services are agreed separately.

Changes in the program

The engineers reserve the right to change speakers.

Cancellation of an event by the engineers

The engineers can cancel the event at any time if the event cannot take place for organizational reasons or due to force majeure, such as illness of speakers. We will then inform you as soon as possible via the address, telephone number or email address you provided. In these cases, any amounts already paid will be refunded. Further claims, in particular reimbursement of cancellation or rebooking fees and claims for compensation for damages of any kind, cannot be derived from the cancellation of events.

Withdrawal from a seminar

Unless otherwise agreed in individual cases, online in-house seminars, in-house seminars, online meetings and moderations can be cancelled up to 8 weeks before the selected date for a fee of 10% of the fee. For cancellations up to four weeks before the start of the seminar, 50% of the fee is due and thereafter the full fee is due.

Copyright

Papers and documents created by the engineers (hereinafter referred to as "documents") are protected by copyright law. With the exception of personal, non-commercial use in the context of events, rights of use are only transferred by expressly granting rights of use in writing. The documents may not be reproduced, distributed or published without our consent.

Liability

  1. The engineers are not liable for the accuracy and completeness of the information in the documents and on the website. They do not guarantee, either expressly or implicitly, that the information provided is suitable for any purpose, that it is capable of fulfilling a specific function, or that it is correct or up to date. The same applies to all other websites referred to via hyperlink. The engineers are not responsible for the content of the websites reached via such a link.
  2. The documents are carefully prepared by the engineers. The documents represent the non-binding and personal opinion of the author(s) on all questions of machine safety, in particular when interpreting the legal regulations referred to. The statements do not replace individual advice on or in a specific individual case.
  3. The engineers are only liable for damages – for whatever legal reasons –
    - in the event of intent,
    - in the event of gross negligence on the part of the owner/the bodies,
    - in the event of culpable injury to life, body or health,
    - in the event of fraudulent concealment of a defect,
    - insofar as liability is assumed under the Product Liability Act for personal injury or property damage to privately used items.
In the event of a breach of contract, the engineers' liability is limited to the amount of the engineers' insurance. Liability for atypical, unforeseeable damage and indirect damage or consequential damage of any kind, such as lost profit, is excluded, unless liability is mandatory as described above. Liability of the engineers for damage caused by computer viruses, espionage programs and other harmful computer programs is also excluded. 

Widerrufsrecht bei Verbrauchern

  1. Widerrufsrecht
    Sie haben das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.
    Um Ihr Widerrufsrecht auszuüben, müssen Sie uns

    mittels einer eindeutigen Erklärung (z. B. ein mit der Post versandter Brief, Telefax oder E-Mail) über Ihren Entschluss, diesen Vertrag zu widerrufen, informieren.
    Sie können dafür das beigefügte Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass Sie die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absenden.
  2. Folgen des Widerrufs
    Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist.
    Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.

    Wir können die Rückzahlung verweigern, bis wir die Waren wieder zurückerhalten haben oder bis Sie den Nachweis erbracht haben, dass Sie die Waren zurückgesandt haben, je nachdem, welches der frühere Zeitpunkt ist.

    Sie haben die Waren unverzüglich und in jedem Fall spätestens binnen vierzehn Tagen ab dem Tag, an dem Sie uns über den Widerruf dieses Vertrags unterrichten, an DCEM - Die CE-Mentoren Dr. Ostermann & Partner Ingenieure, Auf dem Senkel 40, D-53859 Niederkassel zurückzusenden oder zu übergeben. Die Frist ist gewahrt, wenn Sie die Waren vor Ablauf der Frist von vierzehn Tagen absenden.
    Wir tragen die Kosten der Rücksendung der Waren.

    Haben Sie verlangt, dass die Dienstleistungen während der Widerrufsfrist beginnen soll, so haben Sie uns einen angemessenen Betrag zu zahlen, der dem Anteil der bis zu dem Zeitpunkt, zu dem Sie uns von der Ausübung des Widerrufsrechts hinsichtlich dieses Vertrags unterrichten, bereits erbrachten Dienstleistungen im Vergleich zum Gesamtumfang der im Vertrag vorgesehenen Dienstleistungen entspricht.

Prohibition on recording and passing on lectures and other content

  1. The recording of lectures and other content or parts thereof (e.g. sound recordings, photographs, screenshots, video recordings) is prohibited.
  2. The passing on of lectures and other content or parts thereof (e.g. sound recordings, photographs, screenshots, video recordings) to third natural and legal persons is prohibited.
  3. Lectures and other content that are transmitted over the Internet are inevitably reproduced. This is permitted as long as it serves the sole use of the content by the participant.
  4. Lectures and other content that are transmitted over the Internet contain visible and invisible watermarks. In the event of unauthorized passing on or publication of the lectures or other course content, the participant consents to these being used to establish his or her identity.
  5. For each individual case of violation of the recording ban and/or the disclosure ban, the participant undertakes to pay a contractual penalty of EUR 50,000, which will not be offset against any damage suffered by the engineers as a result of the violation of the recording ban.
  6. The participant will indemnify the engineers against all claims for damages or costs (including court fees and reasonable attorneys' fees) and compensate the engineers for all damages resulting from a violation of the recording ban. This obligation also extends to any violation of the recording ban by third parties to whom the participant has passed on the information.

Prohibition on reproduction of lecture materials and other documents

  1. The reproduction of lecture materials and other documents or parts thereof (e.g. copies, photographs, screenshots, scans) is prohibited unless otherwise agreed in writing with the engineers.
  2. Lecture materials and other documents that are transmitted over the Internet are inevitably reproduced. This is permitted as long as it serves the sole use of the documents by the participant.
  3. Lecture materials and other documents that are transmitted electronically can contain visible and invisible watermarks. In the event of unauthorized distribution or publication of the lecture materials and other course materials, the participant consents to them being used to establish his identity.
  4. For each individual case of violation of the prohibition on reproduction, the participant undertakes to pay a contractual penalty of EUR 50,000, which will not be offset against any damage suffered by the engineers as a result of the violation of the prohibition on reproduction.
  5. The participant will indemnify the engineers against all claims for damages or costs (including court costs and reasonable attorneys' fees) and compensate the engineers for all damages resulting from a violation of the prohibition on reproduction. This obligation also extends to any violation of the prohibition on reproduction by third parties to whom the participant has passed on the information.

Copyright on presentation materials

The speakers at the engineers' events

  1. assure that they have the right to show their materials, including texts, images and graphics, as part of the event at which they are appearing.
  2. assure that they have the right to reproduce their materials, including texts, images and graphics, as part of the accompanying materials for the event at which they are appearing. They also assure that they are permitted to transfer this right to the engineers.
  3. transfer to the engineers the right to reproduce their materials, including texts, images and graphics, as part of the accompanying materials for the event at which they are appearing and to make them available to participants. Parts of materials that may only be reproduced to a limited extent (only in print / only digitally) will be specially marked by the speakers.
  4. will indemnify the engineers from all claims for damages or costs arising from a violation of copyright by the speaker.

Changes

The engineers reserve the right to change these GTC if necessary, in particular due to changes in the law or other legal requirements. If such a change restricts the rights of the participant / user granted therein, he / she will be informed of the changes beforehand and the user has an extraordinary right of termination. 

Place of fulfillment; Place of jurisdiction and applicable law 

  1. The place of fulfillment is the registered office of the engineers.
  2. If the participant / user is a businessman, the registered office of the engineers is the place of jurisdiction. However, the engineers are entitled to sue at the headquarters of the participant / user.
  3. The law of the Federal Republic of Germany is to be applied. 

Storage/Saving of the contract text 

The contract text is saved. The customer has no access to the text of the contract via the Internet.

The contract text is also communicated to the customer in text form in the order confirmation so that the contract terms can be called up, printed out or saved in a reproducible form.

The general terms and conditions of the engineers can be viewed on the website http://www.cementor.de/agb.html. You can print out or save this document by using the usual function of your Internet browser ("Save as" or "Print"). 

Statutory warranty law and warranty law 

The legal warranty right applies. This means in particular that the engineers will remedy all defects that are subject to the statutory warranty obligation free of charge in the first two years after delivery of the goods.

Claims for damages are excluded unless essential obligations have been violated, damage has not been caused intentionally or with gross negligence and unless there is injury to life, limb or health.

Subject to the preceding paragraphs, the engineers assume no liability for the topicality, correctness and completeness of the products to be delivered. 

Severability clause

  1. Should individual provisions of these GTC be ineffective or unenforceable or become ineffective or unenforceable after the conclusion of the contract, the validity of the rest of the contract remains unaffected.
  2. The ineffective or unenforceable provision shall be replaced by an effective and enforceable provision whose effects come as close as possible to the economic objective pursued by the contracting parties with the ineffective or unenforceable provision. The above provisions apply accordingly in the event that the terms and conditions prove to be incomplete.
